1.Introduction

Flowium: Flowium is an online music playlist app. flowiumapp.com contains Flowium’s website and the application which works with Spotify API. (Application Programming Interface) The terms and conditions set forth below apply to your use of the services and functionality provided on or through Flowium and it’s related services. By accessing and using The flowiumapp.com, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not accept these Terms & Conditions, you are not authorized to use The flowiumapp.com. We may modify these Terms & Conditions at any time and such modification will be effective upon posting to The flowiumapp.com. These Services are intended for use by individuals 18 years or older. If you are under 18, you may use this Site and Services only with involvement of a parent or guardian.

2.Provided by the flowiumapp.com

We provide you;

Flowium Originals: In this part of the app you can find original playlists curated by musicians, producers or celebrities for Flowium. Original playlists include illustrations and quotations from a book, movie etc.
Flowium Selections: In this part of the app you can find artist’s playlist selections made by Flowium curators.

4.Content & Copyright Policy

We respect Spotify developer content & copyright policy and apply on Flowium.

4.1.Endorsement and promotion

We don't imply or suggest any endorsement, tie-in, co-branding or promotion by Spotify (except as allowed in the Branding Guidelines) or any creator, artist, rightsholders, or sound recording. We display playlists which we get from musicians, celebrities etc. and playlists ,which are already in Spotify, from Spotify.

4.2.Artificial manipulation

We don’t artificially increase, or claim to artificially increase, play counts, follow counts or otherwise manipulate the Spotify Service. This includes: (i) using any bot, script or automated process; (ii) by providing any compensation (financial or otherwise); and (iii) any other means.

4.3.Misleading Use

We don’t confuse or mislead anyone as to the artist, creator or user associated with any Spotify Content. For playlists,which are already in Spotify, we display what Spotify provided. For the playlist,which we get from musicians, celebrities etc, we display selected quotes and cover art.

4.4.Attribution

We may display any Spotify Content. We clearly attribute the content as being supplied and made available by Spotify, by using the Spotify Marks.

You can be accompanied by a link back to the applicable album, content or playlist on the Spotify Service.

We do not offer metadata, cover art, and/or Audio Preview Clips as a standalone service or product. If we create the playlist on Spotify, we use our content or public content.

5.Links to Other Websites

Our service may contain links to third-party websites or services that are not owned or controlled by The flowiumapp.com

The flowiumapp.com has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that The flowiumapp.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

6.Your use of The flowiumapp.com

In the Flowium App, you should sign with a Spotify account. Otherwise you can not reach the full version. After you log in the Flowium app, you can use our sections. First one is the Originals. In the original section you can find a playlist that the Flowium team gets from musicians or celebrities. We believe that if music is food, flowium is the chef. You can find the best playlists with moods. Secondly, we provide you a playlist which is already on Spotify. Spotify artists create lots of cool playlist but you don’t hear any. In the Selections you can find playlists which the Flowium team selected.

7.Digital Millennium Copyright Act (“DMCA”) – Copyright Infringement Complaints

If you are a copyright owner or an agent thereof and believe that any User Content or other Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by contacting us with documents.

8.Termination

We may terminate or suspend your access immediately, without notice or liability for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use The flowiumapp.com will cease immediately.

9.Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of The flowiumapp.com and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall The flowiumapp.com or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if The flowiumapp.com or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

The Flowium app doesn't sell anything. We are an organization that only accepts donations.

The Service is provided to You "AS IS'' and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, The flowiumapp.com, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. The laws of Turkey, excluding its conflicts of law, shall govern this Terms & Conditions. Your use of the Application may also be subject to other local,state, national, or international laws.

13.For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

14.United States Legal Compliance

You represent and warrant that You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and You are not listed on any United States government list of prohibited or restricted parties.

16. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

16.2.Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

17.Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
